Special Reasons

There are occasions where clients are advised to plead guilty because they have no lawful defence or the offence of which they are accused is one of strict liability, the Court is entitled to consider whether there are special reasons not to disqualify a convicted driver or to endorse their licence with penalty points.

In order for the court to consider special reasons, the following must apply:

- The reason must be a mitigating circumstance of the offence,

- The reason must not be a legal defence to the allegation,

- The reason must be directly related to the actual offence

- The reason must be something that the Court should properly consider when deciding the appropriate punishment.

It is of the utmost importance that any application is meticulously prepared and presented, along with appropriate supporting evidence. HG Legal specialises in special reasons arguments and have an impressive record of successfully arguing these cases.

If the special reasons are accepted, they enable the Magistrates to impose a lesser penalty for an offence or in some cases no penalty at all.
